TERMS AND CONDITIONS

DEFINITIONS

The “Seller” is defined as the legal entity Karmiel Desserts LLC. The “Buyer” means the person [legal or natural] who buys the goods. “Goods” is defined as the items to be supplied by the Seller to the Buyer as listed in the invoice.

GENERAL

These Terms and Conditions shall apply to the sale of the Goods by the Seller to the Buyer to the exclusion of all other terms and conditions referred except where the Seller has agreed to such variation in writing and by way of signature. By ordering from Karmield Desserts LLC you agree to be legally bound by these Terms and Conditions and accept that these conditions may be modified or amended and posted on this website from time to time.

OUR GUARANTEE

The Seller will provide a professionally decorated dessert in a timely manner as specified in the invoice or contract. We appreciate your business and we are honored that you have chosen us for your special celebration. We guarantee that the flavors, size, and general design elements will be met as outlined. If you are not satisfied with our product(s) please let us know at the time you receive your order. Once your order is accepted, refunds will not be considered.

PAYMENT AND DEPOSIT

We require a 25% non-refundable and non-transferable deposit to reserve the date and confirm an order. The remaining 75% is due the delivery date. The changes must be confirmed two weeks before. Orders placed less than 2 weeks in advance of the delivery date must be paid in full. Payment can be made earlier if you wish. Deposits are non-refundable. Full payments made less than 2 weeks in advance of the delivery date are non-refundable.

PRICE QUOTATIONS

All price quotations, written or verbal, are valid for 30 days from the date of quotation.

ALTERATIONS OR VARIATIONS

If you have any queries or need to make any changes to an order please contact us immediately. We will assess your request for an alteration and let you know its effect on the price and any agreed timetable. Accepting any alterations is at the discretion of the Seller. Alterations requested less than 2 weeks before completion may be subject to a surcharge.

Although we make every attempt to provide an exact design and to match colors, custom cakes are a work of art. It may not be possible to match an exact shade of a color, but we will come as close as possible. The final product may be subject to slight variations. Also be aware the exposure to light can cause colors to change. We do not offer discounts or refunds if the exact shade of a color is not achieved or if a variation occurs due to lighting. In the event that a major variation needs to be made the Seller will communicate this to the Buyer and seek re-design approval.

REFUNDS, CREDITS AND CANCELLATIONS

Karmiel Desserts will not offer refunds or exchanges for custom products that meet our quality standards once a Good has been picked up/delivered and “Accepted” by Buyer or another designated party. All products are the responsibility of the Buyer once it leaves our possession. Refund requests due to decorating style, color shade or general decoration design will not be honored or considered.

We only give refunds if the product arrives late, damaged, does not meet the flavor, size, and general description detailed in the order. Keep in mind, variety in temperature and humidity may impact the flavor, overall design, or texture of the cake to some degree. Please understand we cannot control changes in texture or changes in color or shape due to weather conditions.

The Seller will attempt to perform its services in a professional manner and provide the best customer experience possible. In the event that our products or services do not meet our high standards, or the client is dissatisfied, we may -at the Seller discretion- provide the amount paid for those products and services in the form of store credit.

We cannot refund any of the cost of an order cancelled with less than 2 week’s notice. Orders paid in full and cancelled with more than 2 weeks notice will receive a partial refund of 50% of the total amount paid. In the unlikely event that we have to cancel your order for any reason, then we will give you as much notice as possible, and discuss the matter with you and try to agree a suitable alternative. If you are not willing to accept our suggested alternative, then we will refund the full price to you.

DELIVERY

The delivery time will be confirmed at least two (2) business days before your event date. Goods maybe setup 1-3 hours before your event.

In the case of an unavoidable occurrence, such as an act of god, a car accident, poor road conditions, or dropping of the Goods during delivery — Karmiel Desserts cannot be held liable for more than the price of the cake described in this order.

If the Buyer or Buyer representative is not available to receive the delivery. A re-delivery fee will be required at the time of receipt of goods and services.

DAMAGES

The Seller accepts no liability for Goods that are damaged after they have been delivered to the agreed location. For Goods delivered to venues, the Seller requires a signed delivery note by the person in charge to say that the Goods have arrived and that it arrived in perfect condition. Goods collected from the Seller location require a signed collection note by the person in charge to say that the Goods were collected in perfect condition. Damages after this point are not Karmiel Desserts LLC responsibility.

The Seller accepts no liability for Goods or decorations damaged, that are delivered or prepared on outside locations, due to weather conditions such as rain, wind or extreme heat.

All Karmiel Desserts Goods are fragile and require care and attention when handling, storing, and displaying. Please pay careful attention to our storage and transportation (where relevant) instructions that will be provided with the Good.

The product may contain or come into contact with milk, wheat, nuts, soy and other allergens. The Buyer is responsible for notifying the guests. The Seller is not responsible for any adverse effects of allergic reactions.

PHOTOS AND MARKETING

We respect the privacy of all our clients. We will not disclose the identity of clients (photographs of people, last names, event details, contract details) without permission. We do however, reserve the right to photograph the Goods and use those photos on our website, social media, or marketing materials. We also reserve the right to use any photographs for display or promotion without compensation to you.

RENTAL ITEMS

All rental items will be for a seven (7) day period. The day of the event and up to six (6) days after. A late fee of $20.00 per day will be imposed for each day the items are late. Should any parts be not returned or damaged in any way, the Buyer will be responsible for the cost of replacing the entire item.
